These Terms & Conditions (the "Terms") form a binding agreement between you and SuperFastFiles ("SuperFastFiles", "we", "us" or "our"), the operator of the website at superfastfiles.com. They govern your access to and use of the website and every tool, feature and account offered through it.

Please read them carefully. By accessing or using the Service, you accept these Terms in full, including Section 15, under which the Service is provided without any guarantee that it will be available, that any conversion will succeed, or that any file will be kept. If you do not accept these Terms, you must not use the Service.

1. Acceptance of These Terms

1.1 By accessing, browsing or using the Service in any way, including by visiting the Site, using any Tool, uploading or importing a File, or creating or signing in to an Account, you confirm that you have read and understood these Terms and agree to be bound by them, together with any additional terms displayed for a particular Tool or feature.

1.2 When you create an Account, you also confirm your agreement expressly, as described in Section 5.1.

1.3 Your acceptance includes, in particular, your acceptance of Section 15: the Service is provided without any guarantee of uptime, continuity or availability, without any guarantee that any conversion or other processing will succeed or produce output of any particular quality, and without any obligation on us to keep a copy of any File.

1.4 Your continued use of the Service after these Terms have been changed under Section 23 means that you accept the changed Terms.

1.5 If you use the Service on behalf of a company or other organization, you confirm that you have the authority to accept these Terms on its behalf, and "you" then includes that organization.

1.6 If you do not agree to these Terms, or to any later version of them, you must stop using the Service.

1.7 Our Privacy Policy describes how we collect and use personal information in connection with the Service.

2. Definitions

2.1 In these Terms:

  • "Service" means the Site, the Tools, Accounts, and all related features, content and functionality we provide.
  • "Site" means the website at superfastfiles.com and its subdomains.
  • "Tool" means any individual function of the Service, such as a converter, merger, organizer, compressor, password tool, redaction tool, signature tool, translation tool or repair tool.
  • "File" means any document, image, video, audio, archive, text or other content that you upload, import, open or otherwise submit to a Tool, together with any password, signature, text or other information you enter into a Tool.
  • "Output" means any file or other content that a Tool produces from a File.
  • "Account" means a user account registered with the Service.
  • "Third-Party Processor" means a service provider other than us that processes Files on our behalf to perform a Tool's function, such as a document conversion provider or a machine translation provider.
  • "Signature Certificate" means the optional record page that Sign PDF can attach to a signed document.

2.2 Headings are for convenience only and do not affect interpretation. The words "including", "for example" and similar expressions mean "including without limitation".

3. Our Service

3.1 The Tools

3.1.1 SuperFastFiles provides online tools for working with files. At the date of these Terms, they include tools for converting documents, spreadsheets, presentations, images, video, audio and archives between formats; merging files; organizing and reordering pages and sheets; compressing PDF files; adding and removing PDF passwords; redacting PDF files; applying electronic signatures to PDF files; translating documents; and repairing damaged PDF files.

3.1.2 At the date of these Terms, every Tool except Translate Document can be used without an Account. Translate Document is available only to users who are signed in to an Account, and each Account may translate up to a daily number of characters that we set and show on the Site. Some features, such as importing Files from Google Drive or Dropbox, are also available only to users who are signed in to an Account.

3.1.3 Tools differ in where they process Files (see Section 12) and in the limits that apply to them, such as the maximum file size (up to 2 GB for some Tools and less for others), the number of files, the amount of text, and the time allowed for an upload to complete. The limits that apply to a Tool are those shown on the Site at the time you use it, and they may change at any time.

3.1.4 The descriptions of the Tools on the Site explain how each Tool is designed to work. They are not a guarantee that every File will be processed in that way or with that result, and Sections 15 and 19 apply to them.

3.1.5 The Service is a file processing service only. It is not a file storage, backup, archiving or document management service, and it does not provide legal, professional translation, notarization or certification services.

3.1.6 We may add, change or remove Tools, features, supported formats, limits and processing methods at any time, as described in Sections 15 and 23.

3.2 Importing from Google Drive and Dropbox

3.2.1 If you are signed in to an Account, you may import Files from Google Drive or Dropbox instead of choosing them from your device. Importing is optional.

3.2.2 To import from Google Drive, you choose Files in Google's own file picker and authorize access through Google; the access requested is limited to the Files you pick. To import from Dropbox, you choose Files in Dropbox's own file chooser, which may ask you to sign in to Dropbox.

3.2.3 An imported File is downloaded into your browser and is then handled exactly as if you had chosen it from your device: the same limits and checks apply, and it is processed in the way described in Section 12 for the Tool you are using.

3.2.4 We do not upload, save, change or delete anything in your Google Drive or Dropbox, and we keep no standing connection to either service. The permission to read the Files you pick from Google Drive is requested when you import and is kept in your browser for no longer than one hour. You can review and withdraw the access you have granted to Google Drive at any time in your Google Account settings.

3.2.5 Your use of Google Drive and Dropbox is governed by the terms of service and privacy policies of Google and Dropbox respectively, which apply in addition to these Terms. You must have the right to access and process any File you import. We are not responsible for those services, for their availability, or for any change they make that affects importing, and we may withdraw importing from either service at any time.

3.3 Electronic Signatures (Sign PDF)

3.3.1 What Sign PDF does. Sign PDF lets you place a typed signature, an optional date and an optional image, such as a company stamp, onto a PDF. You may also attach a Signature Certificate that records the time of signing, what was placed on which page, the consent wording you agreed to, and SHA-256 fingerprints of the document. Sign PDF runs in your browser: your PDF, your signature and the Signature Certificate are not uploaded to us.

3.3.2 Electronic signature under US law. A signature you apply yourself with Sign PDF is an electronic signature under the United States Electronic Signatures in Global and National Commerce Act (the "ESIGN Act") and the Uniform Electronic Transactions Act ("UETA") as adopted in the states of the United States. Under those laws, a signature may not be denied legal effect, validity or enforceability solely because it is in electronic form. Whether a particular signed document is valid and enforceable nonetheless depends on matters outside the Tool, including the intent of the person signing, the agreement of the parties to do business electronically, whether the signature can be attributed to the person who signed, whether an accurate record of the document is kept, and any law that requires a particular form of signature.

3.3.3 Qualified signatures. In many countries, only an electronic signature created with a qualified electronic certificate, known for example as a qualified or secure electronic signature, has the same legal effect as a handwritten signature. A signature made with Sign PDF is not such a signature, and it cannot be used for a transaction that the applicable law requires to be signed by hand or with a qualified or secure electronic signature.

3.3.4 Not a certificate-based digital signature. Sign PDF does not create a certificate-based digital signature. It does not use a digital certificate issued by a certification authority, it does not cryptographically bind the signature to your identity, and PDF reader software will not show the signature as a validated digital signature. It is not an advanced electronic signature or a qualified electronic signature under the European Union's eIDAS Regulation or under any equivalent scheme elsewhere.

3.3.5 No accreditation. SuperFastFiles is not a certification authority, electronic certificate service provider, trust service provider or accredited signature provider, and it holds no accreditation, certification or approval for Sign PDF from any government, regulator or standards body.

3.3.6 No identity verification. We do not verify the identity of anyone who uses Sign PDF, and we do not confirm that the person signing is the person named in the signature. We do not witness, notarize, deliver or store signed documents. The Signature Certificate records only what happened in the browser in which the document was signed; it does not record an IP address, an email address or other information identifying the person who signed.

3.3.7 Your records. Because Sign PDF runs in your browser, we hold no copy of the signed document, the Signature Certificate or any other record of the signing, and we cannot provide one later as evidence. You are responsible for keeping the signed document, the Signature Certificate and any other evidence you may need.

3.3.8 Your responsibility. You are responsible for having the authority to sign; for signing only in your own name or with the authority of the person for whom you sign; for obtaining any consent the other parties must give to transact electronically; and for giving any disclosures, copies or records that the law requires. Some documents cannot validly be signed electronically, or require witnessing, notarization, a handwritten signature, or a certificate-based, secure or qualified signature. Under the ESIGN Act and UETA, for example, the exceptions include wills, codicils and testamentary trusts, certain family law matters, court orders and official court documents, and certain notices required by law. The law of other countries may impose different requirements.

3.3.9 Legal and regulatory requirements. If you are subject to specific legal, regulatory, contractual, industry or evidential requirements for signatures, including the requirements of a regulator, a court, a counterparty or a professional body, you must satisfy yourself that Sign PDF is adequate for your purpose before relying on it, taking independent legal advice where appropriate. We make no representation that a signature made with Sign PDF will be accepted by any particular person, organization, court or authority.

3.4 Redaction (Redact PDF)

3.4.1 What Redact PDF does. Redact PDF removes the text and image pixels within the areas you select or draw on a PDF, and any drawing that lies entirely within them, checks the result, and produces a new PDF. It processes your File on our servers, as described in Section 12. As part of redaction, it may also remove other data from the File, such as metadata, links, comments, form fields, bookmarks and attachments.

3.4.2 Verify before sharing. The effectiveness of a redaction depends on what you mark. Before you share, publish, file or otherwise disclose a redacted document, you must check the Output yourself, page by page, to confirm that everything you intended to remove has been removed and that nothing has been removed by mistake. For example, you should search the Output for the words, names and numbers you redacted, and open it in more than one PDF reader.

3.4.3 Limits of the Tool. Redact PDF removes page content only within the areas you mark. Information that appears anywhere else in the document, such as the same name on another page, in a header, or in an image you did not mark, remains unless you mark it too. A word that a marked area only partly covers may be removed whole. A drawing that a marked area only partly covers is not removed, including the part inside that area. The check the Tool performs on the Output is an aid, not a guarantee that a redaction is complete.

3.4.4 Your responsibility. You are solely responsible for deciding what to redact, for checking the Output, and for the consequences of disclosing a redacted document, including the disclosure of any information that was not removed. To the fullest extent permitted by law, we are not liable for any loss arising from incomplete, incorrect or excessive redaction.

3.4.5 Keep your original. Redaction cannot be undone in the Output, and we do not keep your original File. Keep your own copy of it.

3.5 Document Translation (Translate Document)

3.5.1 Machine translation. Translate Document produces a machine translation of a document using automated systems, including a Third-Party Processor that provides machine translation. No human translator is involved in producing the translation.

3.5.2 Errors. Machine translation can be inaccurate, incomplete or unsuitable for its context. It may mistranslate or omit words, names, numbers, dates, amounts and technical or legal terms, and it may change meaning, tone or level of formality. Translated text is often longer than the original, so it may not fit the original layout, and line and page breaks may change. Some content, such as text in images, charts and comments, is not translated.

3.5.3 Your review. You are responsible for reviewing the Output and, where necessary, correcting it before you use, rely on, publish or share it. The Output is not a certified, sworn or official translation, and it must not be used as the sole basis for any legal, medical, financial, safety-related, regulatory, academic or other important decision or purpose without review by a qualified human translator.

3.5.4 Confidentiality. The text of your document is transmitted to the machine translation provider, which processes it under its own terms (see Section 13.3). Do not submit content that you are not permitted to disclose to a third party, or that you are not willing to have processed on those terms.

3.5.5 Edits are not saved. We keep the document and the edits you make in the Tool only while the page is open, so that the Tool can show and produce the Output, and they are then deleted as described in Section 12.2. We do not save them for you, so they are lost when you close or leave the page, unless you have downloaded the Output first.

3.6 Conversion, Compression, Passwords and Repair

3.6.1 Conversion. Each conversion Tool is designed to keep the content and appearance of your File, but converting between formats may not reproduce every element exactly, such as fonts that are not embedded, complex layouts, links, comments, macros, form fields, interactive features or metadata. Text recognition (OCR) applied to scanned pages may misread characters, names and numbers. You must check the Output before relying on it.

3.6.2 Compression. Compressing a PDF may reduce the quality of its images and may remove digital signatures, passwords, permissions and other properties of the original File. A PDF that is already as small as it can reasonably be made may not become smaller.

3.6.3 Merging and organizing. When you merge Files or organize pages or sheets, you are responsible for checking that the Output contains the content and order you intended.

3.6.4 Password protection. When you password-protect a File, the password you choose is used only to encrypt that File. We do not keep your password, and we cannot recover it, reset it or open the protected File for you. If you lose the password, you may permanently lose access to the File's contents.

3.6.5 Password removal. You may use Unlock PDF, or any other Tool that removes protection from a File, only for Files you own or are authorized to unlock, and only with a password you are entitled to use.

3.6.6 Repair. Repair PDF attempts to rebuild damaged PDF files. It cannot recover data that is no longer present in a File, may recover only part of a document, and may change a File's structure or appearance. Any report it gives of what was recovered is produced automatically and may be incomplete or inaccurate. Keep your damaged original.

3.6.7 Video and audio. Where the target format can hold the original video or audio stream, it is copied unchanged. Where it cannot, the stream is re-encoded at a high quality setting intended to be indistinguishable from the original, so the Output is not a bit-for-bit copy of it. If you choose a smaller resolution, the picture is reduced accordingly.

3.6.8 Archives. Archive Converter unpacks and repacks the files inside an archive without changing their contents, but it may not preserve every file attribute, such as permissions or timestamps, in every format, and some formats can be read but not created.

4. Eligibility and Minimum Age

4.1 You may use the Service only if one of the following applies to you:

  • you are 18 years of age or older;
  • you are at least 16 years old, live independently, and have the legal capacity to accept these Terms yourself (for example, because a court has declared you to be of full age, or because you are married); or
  • you are under 18 and use the Service with the permission, and under the responsibility, of a parent or legal guardian, as set out in Section 4.3.

4.2 In every case, you must not have been prohibited by a court or any other competent authority from using services of this kind or from entering into agreements such as these Terms, and we must not have previously suspended or terminated your access to the Service.

4.3 Minors. If you are under 18 and the second case in Section 4.1 does not apply to you, you may use the Service, and hold an Account, only with the permission and under the responsibility of a parent or legal guardian. The parent or legal guardian who gives that permission accepts these Terms on your behalf and is fully responsible for all of your acts and omissions in connection with the Service, including all use of your Account and your compliance with these Terms.

4.4 To the fullest extent permitted by law, we accept no liability for any act of a minor, or for any consequence arising from a minor's use of the Service.

4.5 The Service is not intended for children under 13. Children under 13 must not use the Service or create an Account, even with a parent's or guardian's permission.

4.6 Some uses of the Service, such as signing a legally binding document with Sign PDF, may require full legal capacity to enter into the relevant agreement. You are responsible for having that capacity.

4.7 We may ask you to confirm that you meet the requirements of this Section, and we may suspend or terminate your access if you do not, or cannot, confirm it.

5. Accounts

5.1 Creating an Account. Creating an Account is optional. You may create one with an email address and password, or with Google. On the sign-up page, you confirm by ticking a box that, by creating an Account, you agree to these Terms and our Privacy Policy, and an Account cannot be created there without that confirmation. If you continue with Google from the log-in page and do not yet have an Account, an Account is created for you, and by continuing you agree to these Terms and our Privacy Policy.

5.2 Confirmation. An Account created with an email address must be confirmed through the link we send to that address before it can be used.

5.3 Signing in with Google. When you sign in with Google, Google's own terms and privacy policy also apply to that sign-in, and we receive basic profile information from Google, such as your name and email address.

5.4 Accurate information. You must provide accurate, current and complete information when you create an Account, and keep it up to date. You must register with an email address that belongs to you and that you control, and you must not create an Account using another person's identity.

5.5 One person per Account. Each Account is for one individual person only. You must not share your Account or its sign-in details with anyone else, create an Account for or in the name of another person without their authority, create Accounts by automated means, or create additional Accounts to get around a limit or a suspension.

5.6 Minors. A minor may hold an Account only in accordance with Section 4, and the parent or legal guardian who permits it is responsible for all use of that Account.

5.7 Your credentials. You are responsible for keeping your password and other sign-in credentials confidential and secure, including access to the email address and any Google account linked to your Account, and for all activity that takes place under your Account.

5.8 Unauthorized use. You must tell us promptly at support@superfastfiles.com if you become aware of any unauthorized use of your Account or any other breach of security relating to it. To the fullest extent permitted by law, we are not liable for any loss arising from unauthorized use of your Account.

5.9 Account emails. We send the emails needed to operate your Account, such as confirmation links and password reset codes, and we may send important notices about your Account or these Terms.

5.10 Suspension and termination. We may suspend, restrict or terminate your Account, with or without notice, if we reasonably believe that you have breached these Terms, that your Account has been compromised, that your use of the Service creates a risk or legal exposure for us or for others, or where we are required to do so by law. Section 18 applies.

5.11 Deleting your Account. You may stop using your Account at any time. You may ask us to delete your Account by contacting us at support@superfastfiles.com from the email address associated with it, or by using any deletion feature we make available.

5.12 No storage. An Account does not provide storage. Files and Output are not saved to your Account.

6. Limited Use

6.1 Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to access and use the Service for its intended purpose, for your own personal or internal business purposes.

6.2 This right covers use of the Service only through the user interface we provide on the Site, in a web browser, and within the limits that apply to each Tool. You must not access any server, endpoint or programming interface used by the Service in any other way, or use the Service as a back end for any other application, website or service.

6.3 You must not sell, resell, sublicense, rent, lease, frame, mirror or otherwise commercially exploit the Service or access to it, offer it to others as part of a product or service of your own, or present it as your own.

6.4 You must not use the Service, or any information obtained from it, to build, train or improve a competing product or service.

6.5 All rights not expressly granted to you in these Terms are reserved (see Section 16). Your right under this Section ends automatically if your access to the Service is suspended or terminated.

7. Acceptable Use

7.1 You may use the Service only for lawful purposes and in accordance with these Terms. You must not, must not attempt to, and must not help or allow anyone else to:

  • upload, import, process, create or share any content that is unlawful, or that is defamatory, obscene, harassing, threatening or hateful, or that violates any person's privacy or publicity rights;
  • upload, import or process any content that depicts or promotes the sexual abuse or exploitation of children. Where the law requires it, we will report such content to the competent authorities;
  • infringe or misappropriate any copyright, trademark, trade secret, patent or other intellectual or industrial property right, including by converting, copying or distributing content that you have no right to use;
  • remove, bypass or circumvent any password, encryption, digital rights management or other technical protection on a File that you are not authorized to remove;
  • process personal data about other people without a lawful basis for doing so;
  • access or use the Service by automated means, including bots, scrapers, crawlers, scripts and automated browsers, or scrape, harvest or extract content or data from the Site, except that public search engines may index public pages of the Site in accordance with our robots.txt file;
  • circumvent, disable or interfere with any limit or restriction of the Service, including file size, file count, text, time and rate limits, the requirement to be signed in for certain features, or any suspension, for example by spreading activity across several Accounts, devices or network addresses;
  • interfere with or disrupt any other user's use of the Service; or
  • use the Service in breach of any applicable law or regulation, including export control and sanctions laws.

7.2 Fraud and impersonation are dealt with in Section 8, malicious software, hacking and other attacks in Section 9, and modification of the Service in Section 10.

7.3 We may, but are not obliged to, investigate any suspected breach of this Section or of Sections 6, 8, 9 or 10. We may block requests, refuse or stop processing any File, suspend or terminate access to the Service, and cooperate with law enforcement authorities, as we consider appropriate.

7.4 Any breach of this Section, or of Sections 6, 8, 9 or 10, is a material breach of these Terms.

8. Fraud, Impersonation and Misrepresentation

8.1 General prohibition. You must not use the Service, or attempt to use it, for or in connection with any fraudulent, deceptive or dishonest purpose, including any scam, phishing campaign, advance-fee or investment fraud, identity theft, money laundering, terrorist financing or other unlawful scheme, or to obtain money, property, services, information or any other advantage by deception.

8.2 Fraudulent documents. You must not use any Tool to create, alter or prepare a forged, falsified or counterfeit document, or any document intended to mislead a person about its origin, authenticity, content, date, author or signatory. This includes, for example, altered or fabricated contracts, invoices, receipts, bank or account statements, payslips, tax records, identity documents, certificates, diplomas, academic transcripts, medical records and official or court documents, as well as any converted or translated document that you present as a faithful version of the original when you know that it is not.

8.3 Signatures, stamps and seals. You must not use Sign PDF to sign in another person's name without their authority, to imitate or forge another person's signature, or to apply a stamp, seal, logo or other mark that you are not authorized to use, and you must not otherwise misrepresent who signed a document, when it was signed or with what authority. Altering a Signature Certificate is dealt with in Section 10.6.

8.4 Impersonating others. You must not impersonate any person or organization, including another user, a company or its officers or employees, a public authority or official, or a professional such as a lawyer, notary or sworn translator. You must not falsely state or imply your identity, age, qualifications, authority or affiliation, whether when creating an Account, when contacting us or when using any Tool. Section 5 sets out further rules for Accounts.

8.5 Impersonating SuperFastFiles. You must not:

  • present yourself as SuperFastFiles, or as acting for it, including as its owner, employee, agent, partner or support team;
  • state or imply that SuperFastFiles sponsors, endorses, approves, verifies or certifies you, your products or services, or any document;
  • create, operate or promote any website, page, application, browser extension, social media account, email address or advertisement that copies or imitates the Site, our name or our branding, or that is likely to be mistaken for them, including by using a domain name, trade name or account name that contains "SuperFastFiles" or a confusingly similar name; or
  • create pages, forms or messages that imitate the Site or our communications in order to obtain passwords, password reset codes, Files, or personal or financial information from anyone.

8.6 Accounts and credentials. In addition to the rules in Section 5, you must not use another person's Account or sign-in credentials without their permission; use credentials obtained by theft, deception or a data breach; or buy, sell, rent, transfer or trade Accounts.

8.7 False information. You must not give us false or misleading information, including in a support request, in a report of abuse or infringement, or in a request concerning an Account, and you must not try to obtain access to an Account, or information about another person, by deceiving us.

8.8 We do not verify documents. We do not verify, certify or vouch for the authenticity, accuracy, origin or lawfulness of any File, Output or other document processed with the Service. The fact that a document was converted, signed, redacted, translated or repaired with the Service, or carries a Signature Certificate, is not evidence that its content is true or genuine, or that it was signed by the person named in it. Anyone who receives such a document should verify it independently.

8.9 How to recognize us. The Service is provided only at superfastfiles.com and its subdomains. Any other website, application or service that presents itself as SuperFastFiles is not ours, unless we say otherwise on the Site. We will never ask you to send us your password or a password reset code, by email or by any other means; a password reset code is only ever entered on the Site's own password reset page.

8.10 Reporting. If you become aware of fraud, impersonation, phishing or any other misuse involving the Service or our name, please report it to us at support@superfastfiles.com, with as much detail as you can.

8.11 Our response. If we reasonably suspect fraud, impersonation or other misuse, we may, with or without notice:

  • refuse or stop processing any File;
  • suspend or terminate access to the Service and any Account involved;
  • block networks, devices or traffic;
  • keep the information we hold that relates to the matter, to the extent the law permits;
  • report the matter to, and cooperate with, law enforcement and other competent authorities; and
  • take legal action, including to recover our losses and to stop the use of confusingly similar names, domain names or websites.

8.12 Responsibility. You are responsible for any loss that arises from your breach of this Section, and Section 21 applies to it. To the fullest extent permitted by law, we are not liable for any loss caused by another person's fraud, impersonation or misuse of the Service, or by any website, message or service that imitates us.

9. Viruses, Hacking and Other Software Attacks

9.1 Malicious material. You must not knowingly introduce to the Service any virus, worm, trojan horse, ransomware, spyware, logic bomb or other material that is malicious or technologically harmful, including any File crafted to exploit weaknesses in the software that reads it. A File that is merely damaged and is submitted in good faith to a repair Tool does not breach this clause.

9.2 Using the Service against others. You must not use the Service to create, package, disguise or distribute malicious software, for example by converting, renaming or repacking an archive so that security software does not detect what it contains, and you must not use the Service or any Output to attack, damage or gain unauthorized access to any other computer, network, device or account.

9.3 Unauthorized access and attacks. You must not attempt to gain unauthorized access to the Service, to the servers on which it runs, or to any server, computer, network or database connected with it. You must not attack the Service through a denial-of-service or distributed denial-of-service attack, or overload, flood or place an unreasonable load on it, including by submitting Files or requests at a volume or frequency beyond ordinary individual use.

9.4 Security testing. You must not probe, scan or test the vulnerability of the Service or of any related system or network, or breach or circumvent any security or authentication measure, without our prior written permission. If you discover a security vulnerability, report it to us at support@superfastfiles.com, and do not exploit it or disclose it to anyone else before we have had a reasonable opportunity to fix it.

9.5 Consequences. Conduct of this kind may be a criminal offence under applicable law. We may report it to the competent law enforcement authorities and cooperate with them, including by disclosing information we hold about you. If you breach this Section, your right to use the Service ends immediately.

9.6 Files are not scanned. We do not scan Files or Output for viruses or other malicious content. Output reflects the File from which it was made and may contain any malicious content that File contained; an archive converted with Archive Converter, for example, contains the same files as the original. You are responsible for using up-to-date security software and for checking Files and Output before you open them.

9.7 No liability for harmful material. We take reasonable measures to protect the Service, but we do not guarantee that it is free of bugs, viruses or other harmful components. To the fullest extent permitted by law, we are not liable for any loss or damage caused by a denial-of-service attack, a virus or other technologically harmful material that may infect your device, programs, data or other material through your use of the Service, your downloading of any Output, or your use of any website linked from the Site.

10. Prohibition of Modification

10.1 You must not modify, adapt, alter or create derivative works from the Service or any part of it, including the Site's software and code, design, layout, text, graphics and other content, except as these Terms or applicable law expressly permit.

10.2 You must not decompile, disassemble or reverse engineer any part of the Service, except to the extent that applicable law expressly permits this despite this restriction.

10.3 You must not tamper with or alter the code that the Service runs in your browser, or the requests it sends to our servers, in order to change how the Service behaves, to get around a limit, or to obtain access you are not entitled to.

10.4 You must not remove, obscure or alter any copyright, trademark or other proprietary notice on the Site.

10.5 Viewing the Site with your browser's own translation, zoom or accessibility features is not a modification for the purposes of this Section.

10.6 This Section does not restrict what you do with your own Files and Output, except that you must not alter a Signature Certificate, or any other record or report that the Service produces, and then present it as unaltered or as produced by the Service.

11. Your Files

11.1 Your rights to upload. You must own each File you submit to the Service, or have all the rights, licences, consents and permissions needed to submit it and to have it processed as described in these Terms, including by Third-Party Processors. Where a File contains personal data about other people, you are responsible for having a lawful basis for processing that data with the Service.

11.2 No ownership claim. We do not claim ownership of your Files or your Output. As between you and us, you keep all the rights you have in your Files, and Output belongs to you to the same extent as the File from which it was produced.

11.3 Permission to process. You grant us, and the Third-Party Processors acting for us, a worldwide, non-exclusive, royalty-free permission to receive, transmit, temporarily store, copy, read, convert, modify and otherwise process each File, solely as necessary to perform the Tool you have chosen and to return the Output to you. This permission ends when the File and its Output are deleted as described in Section 12, except to the extent that a Third-Party Processor retains data under its own terms as described in Section 13.

11.4 Your responsibility. You are solely responsible for your Files, for the Output you create, and for how you use, share or rely on that Output.

11.5 We do not review content. Processing is automated. We do not monitor, view, read, listen to or review the content of Files or Output, and no person at SuperFastFiles looks at them as part of providing the Service. We have no obligation to monitor content submitted to the Service, but we may act under Section 7.3 if we become aware of content that breaches these Terms.

12. How Files Are Handled

12.1 Where processing happens. Depending on the Tool, a File is processed in one or more of the following ways:

  • In your browser. The File is processed on your own device by code running in your web browser and is not uploaded to us. At the date of these Terms this applies, for example, to PDF Merger, Sign PDF, PDF to Excel, the conversions between PDF and image formats and between image formats, and to PDF and spreadsheet files in File Organizer.
  • On our servers. The File is uploaded over an encrypted connection to servers we operate, which are hosted by infrastructure providers, and is processed there. At the date of these Terms this applies, for example, to Video Converter, Audio Extractor, Archive Converter, Repair PDF, Redact PDF and Translate Document.
  • By a Third-Party Processor. The File, or part of it, is transmitted to a Third-Party Processor and processed by it, as described in Section 13. At the date of these Terms this applies, for example, to PDF to Word, Word to PDF, Excel to PDF, PowerPoint to PDF, PDF to PowerPoint, Compress PDF, Password Protect PDF, Unlock PDF and Word files in File Organizer. For these Tools, the File reaches the document conversion provider through the infrastructure provider that hosts the Site, and the Output comes back to you through our servers or, if they cannot receive it, through that hosting provider. Translate Document also sends the text of your document to a machine translation provider, and may send the document to a document conversion provider to prepare it for translation.

The way a Tool processes Files may change at any time without notice. Section 3 of our Privacy Policy describes how each Tool handles Files at present.

12.2 Deletion. We do not keep your Files. Files and Output on our servers are kept only while the page that submitted them remains open, so that you can download the Output, and are deleted automatically within a short time after that page is closed or stops responding. Files processed by a Third-Party Processor are deleted in accordance with that processor's own practices (see Section 13). Files processed in your browser are never received by us and remain on your device under your control.

12.3 Deletion is automated and may not be instantaneous. Residual data may remain for a short time in temporary storage or memory until it is removed or overwritten.

12.4 No recovery. We do not store, back up or archive Files or Output, either for you or in your Account. Once a File or its Output has been deleted, or the page has been closed, or processing has failed, we cannot retrieve it. You must download any Output you need before you leave the page. For Tools that process Files on our servers, closing or leaving the page before processing has finished may cancel it.

12.5 Security. Files uploaded to our servers or to a Third-Party Processor are transmitted over encrypted (HTTPS) connections, and we take reasonable measures to protect Files while we process them. However, no method of transmission or processing is completely secure, and we do not guarantee that a File will not be accessed, intercepted, altered or lost. If a File is highly sensitive, consider using a Tool that processes Files in your browser, or not using the Service for that File.

13. Third-Party Processing

13.1 Some Tools rely on Third-Party Processors, including document conversion and machine translation providers. The Service as a whole also relies on infrastructure providers that host the Site and our servers. Section 12.1 describes which Tools used Third-Party Processors at the date of these Terms.

13.2 By uploading or importing a File to a Tool that uses a Third-Party Processor, you agree to that File, or the relevant part of it (such as its text), being transmitted to and processed by that Third-Party Processor, which may be located in a different country from you.

13.3 Third-Party Processors process Files under their own terms, privacy policies and data retention practices, which we do not control and which may allow data to be retained for longer than we retain it. In particular, the machine translation provider used by Translate Document may retain or use the text submitted to it in accordance with its own terms. If you do not want a File processed by a third party, do not use a Tool that relies on one.

13.4 We choose Third-Party Processors with care but, to the fullest extent permitted by law, we are not responsible for their acts or omissions, availability, security or handling of data.

13.5 We may add, replace or remove Third-Party Processors at any time. Our Privacy Policy gives further information about the service providers we use.

14. Confidentiality

14.1 Your Files. We treat the content of your Files and Output as confidential. We do not sell it, and we do not access, use or disclose it except:

  • as necessary to perform the Tool you choose, including by transmitting it to Third-Party Processors and infrastructure providers as described in Sections 12 and 13;
  • where we are required to do so by law, by a court order or by a competent authority; or
  • where necessary to investigate a security incident or a suspected breach of Section 8 or 9.

14.2 Third parties. A Third-Party Processor handles the data it receives under its own terms (see Section 13.3), including the machine translation provider described in Section 3.5.4. Our obligations under this Section do not extend to a Third-Party Processor's own handling of that data.

14.3 No absolute confidentiality. Section 12.5 applies: no online service can guarantee complete confidentiality. You are responsible for deciding whether the Service is appropriate for a confidential or sensitive File. For such a File, consider a Tool that processes Files in your browser, where nothing is uploaded.

14.4 Your personal information. Personal information we hold about you, such as your Account details and your correspondence with us, is handled as described in our Privacy Policy.

14.5 Your obligations. You must keep your sign-in credentials confidential (see Section 5.7), and you must keep confidential any non-public information about the security of the Service that comes to your knowledge, disclosing it to no one but us.

14.6 This Section continues to apply after your use of the Service ends.

15. Service Availability and No Guarantee of Results

15.1 "As is" and "as available". The Service is provided on an "as is" and "as available" basis. We make no promise, warranty or guarantee of any kind as to the uptime, continuity, availability, speed or performance of the Service or of any Tool.

15.2 Interruptions. The Service, any Tool, and any server or Third-Party Processor on which they depend may be slow, unavailable or interrupted at any time and for any length of time, with or without notice. Causes include scheduled or unscheduled maintenance, updates and deployments; hardware or software failure; high demand or capacity limits; outages of, or changes made by, hosting, network, authentication, conversion, translation and other third-party providers; problems with the internet or with your own device, browser or connection; security incidents and attacks; Force Majeure Events (see Section 22); and any other cause outside our control.

15.3 No guarantee of results. We do not guarantee that any upload, import, conversion or other processing will start, succeed or complete; that it will complete within any particular time; that any File will be accepted; or that any Output will be accurate, complete, usable, free from errors or corruption, or of any particular quality or faithfulness to the original. Processing may fail, time out, wait in a queue or be cancelled, including when you close or leave the page, when your connection is interrupted, or when a time or size limit is reached.

15.4 Changes and discontinuation. We may suspend, modify, limit, restrict access to, or permanently discontinue the Service, any Tool, any feature, any supported format or any limit, at any time, for any reason, and without notice or liability to you.

15.5 No liability for downtime or failures. To the fullest extent permitted by law, we are not liable for any loss or damage of any kind arising from or in connection with:

  • any unavailability, interruption, slowness or downtime of the Service or any Tool;
  • any failed, incomplete, delayed or cancelled upload, import, conversion or other processing;
  • any lost, deleted, damaged or corrupted File or Output;
  • any interrupted or lost work, including edits made in a Tool and not downloaded; or
  • the suspension, modification or discontinuation of any part of the Service.

Section 20 also applies.

15.6 Keep your own copies. The Service is not a storage or backup service. You must keep your own copy of every File you upload or import, and of any Output you need. You must not rely on the Service as the only copy of any File, or as your only means of converting or processing it, especially where a deadline or anything else of importance depends on it.

15.7 Your acceptance. By using the Service, you acknowledge and accept that there is no guarantee of availability, continuity or results, and that you use the Service at your own risk.

16. Industrial and Intellectual Property Rights

16.1 Our rights. All industrial and intellectual property rights in the Service belong to us or our licensors. This includes copyright and related rights, trademarks, trade names, logos, the SuperFastFiles name, domain names, designs, software and code, databases, and the text, graphics, icons and illustrations on the Site, but not your Files or your Output. These rights are protected by copyright, trademark, industrial property and other laws, and by international agreements.

16.2 No transfer of rights. Nothing in these Terms transfers any of those rights to you or grants you any right in them, other than the limited right to use the Service set out in Section 6.

16.3 Restrictions. You must not copy, reproduce, distribute, publicly display or otherwise exploit any part of the Service, including by building a website, application or service that reproduces or imitates the Site, its design or its content, and you must not use our name, logos or trademarks, without our prior written permission, except where the law allows it. Modification of the Service is dealt with in Section 10, and imitating the Service to deceive in Section 8.5.

16.4 Your Files. Your rights in your Files and Output are not affected by this Section (see Section 11).

16.5 Open-source components. Parts of the Service use open-source software, fonts and other third-party materials that are licensed under their own terms. Those terms apply to those components, and nothing in these Terms limits your rights under them.

16.6 Third-party trademarks. Google and Google Drive are trademarks of Google LLC. Dropbox is a trademark of Dropbox, Inc. Microsoft, Word, Excel and PowerPoint are trademarks of the Microsoft group of companies. Other product and company names mentioned on the Site are the trademarks of their respective owners. Their use on the Site does not imply any affiliation with, or endorsement by, those owners.

16.7 Feedback. If you send us suggestions, ideas or other feedback about the Service, we may use them freely and without any obligation to you.

17. Third-Party Websites, Services and Advertising

17.1 The Site may contain links to, or integrations with, websites and services operated by third parties, including Google and Dropbox. They are provided for convenience only. We do not control or endorse them and are not responsible for their content, products, services, availability, security or privacy practices. Your use of them is at your own risk and subject to their own terms.

17.2 The Site may display advertising provided by third parties, such as Google. Advertisers and advertising networks may use cookies and similar technologies, as described in our Privacy Policy and Cookie Policy. We are not responsible for the content of advertisements or for the products, services or websites they promote, and any dealings you have with an advertiser are solely between you and that advertiser.

17.3 Third-party services on which the Service relies may change their terms, features or availability, and those changes may affect the Service without notice.

18. Suspension and Termination

18.1 By us. We may suspend or terminate your access to the Service, to any Tool or to your Account at any time, with or without notice, if you breach these Terms or we reasonably suspect that you have; if your use poses a security, legal or operational risk to the Service, to us or to others; if we are required to do so by law or by a competent authority; or if we discontinue the Service or the relevant part of it. We may also block traffic from particular networks, devices or automated sources.

18.2 By you. You may stop using the Service at any time, and you may ask us to delete your Account as described in Section 5.11.

18.3 Effect. When your access is terminated, your right to use the Service ends immediately, and any File or Output still being processed may be deleted without being returned to you. Sections 3.3.7 to 3.3.9, 3.4.4, 3.5.3, 4.3, 4.4, 8.8, 8.12, 9.5 to 9.7, 11.4, 14, 15, 16, 19 to 22, 24 and 25, and any other provision that by its nature is intended to continue, survive termination.

19. Disclaimer of Warranties

19.1 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, EVERY TOOL AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.

19.2 WITHOUT LIMITING SECTION 19.1, WE DO NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; THAT ANY CONVERSION OR OTHER PROCESSING WILL SUCCEED OR COMPLETE; THAT ANY OUTPUT WILL BE ACCURATE, COMPLETE, RELIABLE OR OF ANY PARTICULAR QUALITY; THAT ANY FILE WILL BE PRESERVED OR RETURNED; THAT ANY REDACTION WILL BE COMPLETE; THAT ANY TRANSLATION WILL BE ACCURATE; THAT ANY FILE OR DOCUMENT PROCESSED WITH THE SERVICE IS GENUINE, LAWFUL OR WHAT IT CLAIMS TO BE; THAT ANY SIGNED DOCUMENT WILL BE ENFORCEABLE IN A PARTICULAR CASE OR ACCEPTED BY A PARTICULAR PERSON OR AUTHORITY; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE, THE SERVERS THAT MAKE IT AVAILABLE, OR ANY OUTPUT ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

19.3 No advice or information, whether oral or written, that you obtain from us or through the Service, including the descriptions of the Tools, the answers to frequently asked questions and blog articles, creates any warranty that is not expressly stated in these Terms.

19.4 YOU USE THE SERVICE AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA THAT RESULTS FROM YOUR USE OF THE SERVICE.

19.5 Some jurisdictions do not allow the exclusion of certain warranties, so some of the exclusions above may not apply to you. If you are a consumer, you may have statutory rights that cannot be excluded or limited by contract, and nothing in these Terms affects those rights.

20. Limitation of Liability

20.1 In this Section, the "SuperFastFiles Parties" means SuperFastFiles and its operators, owners, employees, contractors, agents, licensors and service providers.

20.2 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ANY OF THE SUPERFASTFILES PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, OPPORTUNITY, GOODWILL OR ANTICIPATED SAVINGS, LOSS OR CORRUPTION OF DATA OR FILES, LOSS OF USE, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

20.3 WITHOUT LIMITING SECTION 20.2, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NONE OF THE SUPERFASTFILES PARTIES WILL BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM DOWNTIME OR UNAVAILABILITY OF THE SERVICE; FAILED, INCOMPLETE OR DELAYED CONVERSIONS OR OTHER PROCESSING; LOST, DELETED OR CORRUPTED FILES OR OUTPUT; INTERRUPTED OR LOST WORK; INCOMPLETE OR INCORRECT REDACTION; TRANSLATION ERRORS; RELIANCE ON ANY ELECTRONIC SIGNATURE OR SIGNATURE CERTIFICATE; VIRUSES OR OTHER HARMFUL MATERIAL; THE USE OF THE SERVICE BY A MINOR; FRAUD, IMPERSONATION OR OTHER MISUSE OF THE SERVICE BY ANY OTHER PERSON; ANY WEBSITE, MESSAGE OR SERVICE THAT IMITATES US; THE ACTS, OMISSIONS OR OUTAGES OF ANY THIRD-PARTY PROCESSOR OR OTHER THIRD-PARTY SERVICE; OR ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT, YOUR DEVICE OR YOUR FILES.

20.4 TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE SUPERFASTFILES PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT, IF ANY, THAT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE LIABILITY OR, IF YOU PAID US NOTHING IN THAT PERIOD, FIFTY UNITED STATES DOLLARS (US$50).

20.5 The limitations in this Section apply even if a remedy fails of its essential purpose. They reflect an allocation of risk between you and us that is a fundamental basis of these Terms, without which we would not make the Service available.

20.6 Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for intent or gross negligence where the law does not allow it to be excluded in advance, liability for death or personal injury, and liability for fraud. Where applicable law does not allow a limitation set out in this Section, our liability is limited to the fullest extent that the law allows.

21. Indemnification

21.1 To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless the SuperFastFiles Parties from and against all claims, demands, actions, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to:

  • your Files or Output, or your use of them;
  • your use or misuse of the Service;
  • your breach of these Terms;
  • your violation of any law or of any right of a third party, including intellectual and industrial property rights and privacy rights;
  • any document you sign, redact, translate or otherwise process with the Service, and any reliance by any person on that document; or
  • any activity under your Account.

21.2 A parent or legal guardian who permits a minor to use the Service under Section 4.3 gives the commitment in Section 21.1 for that minor's use of the Service as well as for their own.

21.3 We may assume the exclusive defence and control of any matter for which you must indemnify us, and you agree to cooperate with our defence of it. You must not settle any such matter without our prior written consent.

22. Force Majeure Events

22.1 A "Force Majeure Event" is any event or circumstance beyond our reasonable control, including earthquakes, floods, fires, storms and other natural disasters; epidemics and pandemics; war, terrorism, riots and civil unrest; acts, orders or restrictions of governments, courts or other authorities, including sanctions, embargoes and orders restricting access to the Site; strikes and other labour disputes; failures or interruptions of power, telecommunications or the internet; cyberattacks, including denial-of-service attacks and malicious software; and failures, outages or decisions of hosting, infrastructure, authentication, conversion, translation and other third-party providers.

22.2 We are not liable for any failure or delay in providing the Service, or in performing any obligation under these Terms, that is caused by a Force Majeure Event. While a Force Majeure Event continues, our affected obligations are suspended, and we may suspend or limit all or part of the Service.

22.3 If a Force Majeure Event continues for an extended period, we may discontinue the affected part of the Service without liability to you.

22.4 This Section applies in addition to Section 15.

23. Changes to the Service and to These Terms

23.1 We may change the Service at any time, as described in Section 15.4.

23.2 We may revise these Terms at any time. The revised Terms will be posted on this page, with the date at the top updated. Where we consider a change to be material, we may also give notice of it on the Site or by email to Account holders.

23.3 Revised Terms take effect when they are posted, unless they state otherwise. If you continue to use the Service after revised Terms take effect, you accept them. If you do not agree to revised Terms, you must stop using the Service, and you may ask us to delete your Account as described in Section 5.11.

23.4 YOU ARE RESPONSIBLE FOR PERIODICALLY REVIEWING THESE TERMS & CONDITIONS FOR ANY UPDATES OR CHANGES.

23.5 Some features may be subject to additional terms that are shown to you when you use them. Those additional terms form part of these Terms for that feature and, if they conflict with these Terms, the additional terms prevail for that feature.

24. Governing Law and Jurisdiction

24.1 Governing law. These Terms, and any dispute or claim arising out of or in connection with them or the Service, including non-contractual disputes and claims, are governed by the laws of the jurisdiction in which the operator of SuperFastFiles is established, without regard to its conflict of laws rules.

24.2 Jurisdiction. Subject to Section 24.3, the competent courts of that jurisdiction have jurisdiction over any such dispute or claim.

24.3 Consumers. If you are a consumer, the choice of law in Section 24.1 does not deprive you of the protection of the mandatory provisions of the consumer protection law that applies to you, including any right that law gives you to bring a complaint before a consumer dispute resolution body or to bring proceedings in the courts of the place where you live.

24.4 Resolving disputes informally. Before bringing any formal claim, you agree first to contact us at support@superfastfiles.com and to try in good faith, for at least 30 days, to resolve the dispute informally. Where the applicable law requires mediation or another procedure before a claim may be brought, that requirement also applies. This Section does not affect any time limit that applies by law.

25. General Provisions

25.1 Entire agreement. These Terms, together with any additional terms under Section 23.5, are the entire agreement between you and us concerning the Service, and they replace all earlier agreements, understandings and versions of these Terms concerning it.

25.2 Severability. If any provision of these Terms is found to be invalid, illegal or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if that is not possible, removed. The remaining provisions continue in full force and effect.

25.3 No waiver. If we do not enforce a provision of these Terms, or delay in doing so, that does not waive our right to enforce it later. A waiver is effective only if it is made in writing.

25.4 Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms, in whole or in part, including in connection with a merger, acquisition, reorganization or sale of assets.

25.5 Notices. We may give you notices by posting them on the Site or by email to the address associated with your Account. You may give us notices by email to support@superfastfiles.com.

25.6 Relationship. Nothing in these Terms creates a partnership, joint venture, employment or agency relationship between you and us.

25.7 Third parties. Except for the SuperFastFiles Parties under Sections 20 and 21, no third party has any right to enforce these Terms.

25.8 Language. These Terms are written in English. Any translation of them, including one made with our own Tools, is provided for convenience only, and the English version prevails if there is any conflict.
